Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and The Pickle Jar LLC ("we", "us", "our") governing your access to and use of our website, mobile applications, and services (collectively, the "Service"). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Account Responsibilities
You must provide accurate information when creating an account and keep it up to date. You are responsible for safeguarding your credentials and for all activity that occurs under your account. Notify us immediately at hello@thepicklejar.io if you suspect unauthorized access. You must be at least eighteen (18) years old, or the age of majority in your jurisdiction, to create an account on behalf of a facility.
2. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of these Terms.
- Attempt to gain unauthorized access to any portion of the Service.
- Reverse-engineer, decompile, or scrape the Service except as permitted by law.
- Upload malicious code, spam, or content that infringes on third-party rights.
- Use the Service to harass, threaten, or discriminate against other users.
- Resell, sublicense, or redistribute the Service without our written consent.
3. Subscription and Payment Terms
The Service is offered on a monthly subscription basis. Fees are charged at the start of each billing period and are non-refundable except as expressly stated below or as required by law. We may change subscription pricing on thirty (30) days' notice via email or in-product notification.
Card-processing fees are charged by Stripe or Square directly and are not part of our subscription fee. We do not mark up card-processing fees.
4. Refunds and Cancellation
You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of your current billing period, and you will retain access to the Service through that date. We do not provide partial-month refunds. If you believe you have been billed in error, contact hello@thepicklejar.io within thirty (30) days of the charge.
5. Your Content
You retain ownership of all data, content, and information you upload to the Service ("Customer Data"). You grant us a limited, non-exclusive license to host, copy, transmit, and display Customer Data solely as necessary to provide the Service. You represent that you have all rights and consents necessary for us to do so.
6. SMS Communications
If you provide your phone number and opt in, you agree to receive transactional SMS messages from The Pickle Jar and participating facilities about booking confirmations, booking updates, cancellations, waitlist openings, and facility account notices. Message frequency varies. Message and data rates may apply. Reply STOP to opt out. Reply HELP for help.
7. Our Intellectual Property
The Service, including all software, designs, logos, and content we create, is owned by us and our licensors and protected by copyright, trademark, and other laws. Except for the limited license to use the Service granted in these Terms, we reserve all rights. "The Pickle Jar" is our trademark.
8. Termination
We may suspend or terminate your access to the Service at any time, with or without notice, if you violate these Terms, fail to pay fees when due, or engage in conduct that we reasonably believe poses a risk to us or to other users. Upon termination, your right to use the Service ends immediately. Sections that by their nature should survive termination (including ownership, disclaimers, indemnification, and limitations of liability) will survive.
9. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, OR DATA, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.
11. Indemnification
You agree to defend, indemnify, and hold us harmless from any claim, damage, or expense (including reasonable attorneys' fees) arising from your use of the Service, your Customer Data, or your violation of these Terms.
12. Governing Law
These Terms are governed by the laws of the State of Texas, without regard to its conflict of laws principles. Any dispute arising out of or related to these Terms or the Service will be resolved exclusively in the state or federal courts located in Texas, and you consent to personal jurisdiction in those courts.
13. Changes to These Terms
We may update these Terms from time to time. Material changes will be posted to this page and, where appropriate, communicated by email or in-product notification. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
